1. Definitions
In these Terms and Conditions:
- "Wan Hei" / "we" / "us" / "our" refers to Wan Hei Senior Living Residence, located at 102 Plover Cove Road, Tai Po, New Territories, Hong Kong.
- "Service" refers to the senior living arrangements and support services provided by Wan Hei, as described on our website and in individual residence agreements.
- "User" / "you" refers to any person who uses this website or enquires about or engages our services.
- "Resident" refers to an individual who has entered into a residence arrangement with Wan Hei.
- "Agreement" refers to these Terms and Conditions together with any signed residence arrangement document.
2. Acceptance of Terms
By using our website, submitting an enquiry form or entering into a residence arrangement, you agree to be bound by these Terms. Residence arrangements may only be entered into by persons aged 18 or over with full legal capacity to do so. Where a family member or authorised representative acts on behalf of a prospective resident, that person confirms they have authority to do so.
These Terms govern general use of our website and enquiry process. Specific residence arrangements are governed by a separate signed document provided prior to commencement.
3. Service Description
Wan Hei provides senior living arrangements for older adults in Tai Po, New Territories, Hong Kong. Our services currently include three arrangements: Daily Living Support (HK$1,150/month), Excursions and Day Outings (HK$2,380/month), and Complete Residence Living (HK$3,840/month). Full details of each arrangement are described on our website and in individual residence documents.
Services are available to residents in Hong Kong. We do not currently operate outside Hong Kong. Service availability is subject to room occupancy and suitability assessment.
4. User Responsibilities
When using our website or enquiry process, you agree to:
- Provide accurate and honest information in all communications with Wan Hei
- Use the website for lawful purposes only
- Not transmit harmful, offensive or misleading content through any enquiry channel
- Respect the privacy of other residents and staff of Wan Hei during any visit
5. Residence Arrangements and Payment
Residence arrangements are month-to-month. Fees are payable in advance on the first day of each calendar month in Hong Kong Dollars (HKD). Accepted payment methods will be confirmed in the individual residence document. All fees are stated inclusive of services described for each arrangement; no further charges are added without written notice.
Changes to an arrangement (adding or reducing services) are effective from the start of the following calendar month, subject to availability. One calendar month's written notice is required to end an arrangement.
6. Intellectual Property
All content on this website — including text, images and design — is the property of Wan Hei. You may view and print pages for personal, non-commercial use. You may not reproduce, redistribute or use website content for commercial purposes without our written permission.
7. Disclaimers
Wan Hei is a lifestyle residence, not a medical or clinical facility. Our services do not constitute healthcare, nursing care or medical supervision. We make no representation that our services are a substitute for medical care. Families and prospective residents should ensure Wan Hei is appropriate for the individual's current needs before entering into an arrangement.
Website content is provided for informational purposes. We make reasonable efforts to keep information accurate and current but cannot guarantee completeness or suitability for any particular purpose.
8. Limitation of Liability
To the fullest extent permitted by Hong Kong law, Wan Hei's liability for any claim arising from use of our website or services is limited to the amount paid for the service in the month in which the relevant event occurred. We exclude liability for indirect, consequential or economic losses. Nothing in these Terms limits liability for personal injury or fraud.
9. Termination
Either party may end a residence arrangement with one calendar month's written notice. In cases of serious breach of the residence agreement by a resident or their authorised representative, Wan Hei reserves the right to terminate the arrangement on shorter notice, with written explanation provided. On termination, fees paid for unused full months will be refunded on a pro-rata basis.
10. Governing Law and Disputes
These Terms are governed by the laws of Hong Kong. Any dispute arising from these Terms or our services will first be subject to good-faith negotiation. If unresolved within 30 days, either party may refer the matter to mediation before the Hong Kong Mediation Centre. The courts of Hong Kong have jurisdiction over any unresolved legal proceedings.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of our website after changes constitutes acceptance. For residents with active arrangements, material changes will be communicated with at least 30 days' advance written notice.
